These Terms govern your use of SimpleBMICalc (the “Service”), operated by Blue Harvest (“we”, “us”). By using the Service or purchasing SimpleBMICalc Pro, you agree to these Terms.
1. The Service
SimpleBMICalc provides BMI, body fat, BMR and calorie calculations, optional local tracking, recipe storage, and related health-informational features. The free version is available without payment. SimpleBMICalc Pro is a one-time paid unlock that enables additional features described on our Pro page.
2. Not medical advice
The Service provides general health information for educational purposes only. It is not medical advice and is not a substitute for consultation with a qualified healthcare professional. Do not rely on the Service to diagnose, treat, or prevent any condition. Always consult a doctor before making health, diet, or exercise decisions.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, fraud, or spam.
- Infringe intellectual property rights of Blue Harvest or any third party.
- Probe, scan, scrape, or interfere with the security or integrity of the Service, or attempt to gain unauthorized access.
- Reverse engineer, decompile, or attempt to extract the source code, except to the extent permitted by applicable law.
- Resell, redistribute, or sublicense access to the Service or any Pro features.
4. Intellectual property
Blue Harvest retains all right, title, and interest in and to the Service, including its software, branding, content, and documentation. Pro grants you a limited, non-exclusive, non-transferable right to use the Pro features for personal use.
5. Service availability
We provide the Service on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
6. Payments and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, and refund mechanics are governed by the Paddle Buyer Terms. See also our Refund Policy.
7. Suspension and termination
We may suspend or terminate access to the Service for material breach of these Terms, suspected fraud or security risk, non-payment, or repeated or serious policy violations.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the prior 12 months. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability where excluding it would be unlawful.
9. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
